In his plea, Bharat Gogawale, the chief whip of the Shinde Sena, had claimed that Speaker Rahul Narwekar’s decision to not disqualify 14 Shiv Sena (UBT) MLAs was ‘arbitrary, unconstitutional and illegal’.

Issue notice to these petitions returnable on February 8. Affidavit of reply if any to be filed and served within February 8,” the bench noted.

The Bombay High Court on Wednesday issued notices to respondents in pleas by Bharat Gogawale, the chief whip of the Shiv Sena faction led by Maharashtra Chief Minister Eknath Shinde, and others challenging Speaker Rahul Narwekar’s decision to not disqualify 14 MLAs from the Shiv Sena (UBT). The respondents, including Narwekar, have been asked to file their replies by February 8.

Meanwhile, the Shiv Sena (UBT) has also sought urgent listing in the Supreme Court of their plea against the Speaker’s decision declaring the Shinde faction as the “real Shiv Sena”.
